Terms & Conditions

The terms that govern your use of this website and your relationship with Highmark Lighting & Signage.

Before this goes live: this is a full working draft, not yet reviewed by Highmark’s attorney.
Have counsel confirm it before publishing, particularly the payment, warranty and liability sections, which
should be checked against your actual contracts and Florida contractor-licensing requirements.

1. Who we are

This website is operated by Highmark Lighting & Signage (“Highmark,” “we,” “us,” or “our”), a Florida-licensed commercial sign contractor headquartered at 955 Orange Ave, Suite 120, Daytona Beach, FL 32114. We design, manufacture, install, permit and service commercial signage for businesses throughout Florida. By using this website or engaging Highmark for a project, you agree to the terms below.

2. Acceptance of these terms

By browsing this website, submitting a form, requesting an estimate, or otherwise contacting Highmark through this site, you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please discontinue use of the site.

3. Use of this website

You may browse this site and use its content for the purpose of evaluating and requesting Highmark’s services. You agree not to:

  • Copy, reproduce, republish or redistribute site content for commercial purposes without our written permission;
  • Use automated tools (scrapers, bots, crawlers) to extract content, pricing, or project data from this site;
  • Attempt to gain unauthorized access to any part of this site, its underlying code, or any connected system;
  • Use this site to submit false, misleading, or fraudulent information;
  • Interfere with the normal operation of the site or attempt to disrupt it for other users.

4. Intellectual property

All content on this site — including text, photographs, project images, logos, graphics, and page design — is the property of Highmark Lighting & Signage or is used under license, and is protected by U.S. copyright and trademark law. Nothing on this site grants you a license to use Highmark’s name, logo, or project photography for your own purposes without our prior written consent.

5. Estimates, quotes and proposals

Information published on this website — including service descriptions, capability pages, and any pricing guidance — is provided for general reference only and does not constitute a quotation, offer, or binding contract. A firm price, scope of work, timeline and specification are only established through a written estimate or signed proposal following a site survey and design consultation. Verbal estimates, and any figures discussed before a written proposal is issued, are non-binding and subject to change based on final site conditions, code requirements, and material availability.

6. Project work & permitting

Signage manufacturing, fabrication, and installation work is performed under a separate signed work order or contract for each project, which governs the specific scope, price, and schedule for that job — these Terms & Conditions cover use of the website itself, not the specific commercial terms of an individual project. Where permitting is included in a project’s scope, Highmark will submit the required applications on the client’s behalf, but final approval timelines are set by the relevant municipal or county authority and are outside our control. Site access, utility locates, and any third-party approvals needed to begin or complete work are the client’s responsibility unless the signed agreement states otherwise.

7. Payment terms

Payment terms (deposit amount, progress billing, and final payment) are set out in each project’s individual contract or work order. Unless a signed agreement states otherwise, invoices are due upon receipt, and work may be paused on projects with payments significantly past due. Late payments may be subject to interest charges as permitted under Florida law.

8. Warranties

Highmark provides a workmanship warranty on installed signage as set out in your project agreement; this covers defects in our fabrication and installation, not damage from storms, vandalism, vehicle impact, normal wear, or work performed by others after installation. Manufacturer warranties on components (LED modules, electrical parts, etc.) are passed through separately where applicable. This website itself, and its content, is provided “as is” without warranty of any kind, express or implied, including as to accuracy, completeness, or fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by Florida law, Highmark is not liable for any indirect, incidental, or consequential damages arising from your use of this website or reliance on information published here. Nothing in these terms limits liability that cannot lawfully be excluded, including liability arising from our own negligence in performing contracted work, which is instead governed by the terms of your specific project agreement and applicable law.

10. Third-party links

This site links to third-party resources, including our accreditation bodies (DBPR, BBB, SSSA, BuildZoom) and social media profiles. Highmark is not responsible for the content, policies, or practices of any third-party website linked from this site.

11. Privacy

Information collected through this website, including estimate requests and any analytics data, is handled according to our Privacy Policy.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from use of this website is subject to the exclusive jurisdiction of the state and federal courts located in Volusia County, Florida.

13. Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes to our website or business practices. The “last updated” date above shows when this page was last revised. Continued use of the site after changes are posted constitutes acceptance of the revised terms.

14. Contact
